1. General Information

These Terms and Conditions govern the use of the online store operated at www.potolo.gr by PoTolo Workers’ Cooperative (hereinafter ‘PoTolo’, ‘we’, ‘us’, or ‘our’). By placing an order, you confirm that you have read, understood, and agree to these Terms in full.

These Terms apply to all customers worldwide. Where you are located within the European Union, your rights are additionally protected by EU consumer legislation, including the EU Consumer Rights Directive (2011/83/EU) and Regulation (EU) No 1169/2011 on food information to consumers.

2. Products — Food Goods

PoTolo sells physical food products, including wine and olive oil, shipped in glass packaging. All products are food-grade and comply with applicable EU and international food safety standards.

Product descriptions include relevant information such as origin, variety, volume, and where required by law, allergen and nutritional information in accordance with EU Regulation No 1169/2011. We make every effort to ensure all product information is accurate and up to date. In the event of an error, we reserve the right to correct it without prior notice.

Product images are for illustrative purposes only. Actual appearance, label design, or vintage may vary slightly from those shown.

3. Age Restriction — Alcohol

The purchase of wine and any other alcoholic products from www.potolo.gr is strictly restricted to individuals aged 18 years or older (or the legal drinking age in your country of residence, if higher).

By placing an order containing alcoholic products, you confirm that you are of legal age to purchase and consume alcohol in your country. PoTolo reserves the right to cancel any order where age verification cannot be confirmed, and to refuse delivery if the recipient appears to be under the legal age at the time of delivery.

We take responsible alcohol consumption seriously. Please drink responsibly.

4. Ordering

By completing the checkout process, you are making a binding offer to purchase the selected products. A purchase contract is formed upon receipt of our order confirmation email. We reserve the right to decline any order at our discretion.

You must provide accurate and complete information when placing an order. PoTolo is not responsible for delivery failures or delays arising from incorrect information provided by the customer.

5. Pricing & Payment

All prices are displayed in Euros (EUR, €) and include applicable VAT where required. For orders delivered outside the European Union, additional customs duties, import taxes, or local charges may apply — these are the sole responsibility of the customer.

Payment is accepted via credit or debit card through our secure, encrypted payment gateway. Card details are never stored on our servers. PoTolo reserves the right to modify prices at any time; the price applicable to your order is the one displayed at the time of checkout.

6. Shipping, Packaging & Delivery

Orders are dispatched within 1–3 business days from payment confirmation. Delivery is carried out via courier service. Estimated delivery times vary by destination and are not guaranteed.

All glass-packaged products (wine, olive oil) are carefully packed using protective materials specifically designed to prevent breakage during transit. Each item is individually secured to minimise movement and absorb impact.

Despite our best packaging efforts, damage during transit may occasionally occur. If your order arrives damaged, you must:

  • Photograph the damaged packaging and products before opening or discarding any materials
  • Contact us at welcome@potolo.gr within 48 hours of delivery
  • Retain all original packaging until the matter is resolved

Failure to report damage within this timeframe may affect your ability to claim a replacement or refund. PoTolo will arrange a replacement or refund for verified transit damage at no cost to the customer.

For international shipments, we comply with all applicable regulations regarding the export and import of food products and alcoholic beverages. It is the customer’s responsibility to ensure that the importation of wine and olive oil is permitted in their country and to pay any applicable duties or taxes.

7. Storage & Consumption

PoTolo provides general storage and usage guidance with each product. We recommend that wine be stored in a cool, dark environment away from direct sunlight, and that olive oil be kept sealed in a cool, dry place away from heat sources.

PoTolo is not liable for product deterioration resulting from improper storage or handling after delivery. Consumption of our products is at the customer’s own risk. If you have any food allergies, intolerances, or health conditions, please review all product information carefully before purchase.

8. Right of Withdrawal & Returns

Customers located in the European Union have the right to withdraw from a purchase within 14 calendar days of receiving their order, in accordance with the EU Consumer Rights Directive (2011/83/EU).

However, the right of withdrawal does not apply to:

  • Sealed food or beverage products that have been opened after delivery, due to health protection and hygiene reasons (Article 16(d) of Directive 2011/83/EU)
  • Products that have been personalised or made to specification

To exercise your right of withdrawal on eligible (unopened, sealed) products, please notify us in writing at welcome@potolo.gr within the 14-day period. Returned products must be:

  • Unopened and in original sealed condition
  • Undamaged and in original packaging
  • Accompanied by proof of purchase

Upon receipt and inspection, we will process your refund within 14 days using the original payment method. Return shipping costs are borne by the customer unless the product is defective or incorrectly delivered.

Customers outside the EU may return products within 14 days under the same conditions, subject to applicable local consumer protection laws.

9. Defective or Incorrect Products

If you receive a defective, spoiled, or incorrect product, please contact us at welcome@potolo.gr within 7 days of delivery with photographic evidence. We will arrange a replacement or full refund at no cost to you.

10. Limitation of Liability

To the fullest extent permitted by applicable law, PoTolo shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or products. Our total liability for any claim shall not exceed the value of the relevant order.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Intellectual Property

All content on www.potolo.gr — including text, images, logos, brand names, and design — is the property of PoTolo Workers’ Cooperative and is protected by applicable intellectual property laws. Any reproduction or use without prior written consent is strictly prohibited.

12. Governing Law & Dispute Resolution

These Terms and Conditions are governed by the laws of Greece, and where applicable, by EU consumer protection legislation. In the event of a dispute, we encourage customers to contact us directly at welcome@potolo.gr to seek an amicable resolution.

EU customers also have the right to use the European Commission’s Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr

For disputes that cannot be resolved amicably, the courts of Greece shall have jurisdiction, without prejudice to any mandatory consumer protection rights applicable in the customer’s country of residence.
